After driving his car in front of an oncoming train and barely missing a collision, the 51-year-old driver was charged with operating while intoxicated. As red railroad lights flashed and the train sounded its horn, the man pulled up to the railroad tracks and stopped. Then, he suddenly drove across the tracks, forcing the conductor to put on the brakes and narrowly missing a collison.

After a Sheboygan County deputy pulled the driver over, the man failed a sobriety test and had a BAC of 0.138, far above the legal limit of 0.08. This was the man’s fourth offense of operating while intoxicated, which has a maximum sentence of three years in prison. The legal limit for a person with three OWI offenses is 0.02.
